License Agreement

This License Agreement ("Agreement") is entered into as of the date of acceptance between Pojers ("Licensor") and the individual or entity using Pojers services ("Licensee").

1. Grant of License

Licensor grants to Licensee a non-exclusive, non-transferable license to use Pojers services and materials in accordance with the terms and conditions of this Agreement and the Terms of Service.

2. Intellectual Property Rights

All content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Pojers, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.

3. Restrictions

Licensee agrees not to:

  • Reproduce, modify, prepare derivative works based upon, or otherwise copy any materials from Pojers services without prior written consent
  • Distribute copies of materials from Pojers services or use materials for any purpose that competes with Pojers
  • Remove or alter any proprietary notices, labels, or marks on any materials from Pojers services
  • Use any materials from Pojers services for any illegal purpose or in violation of any applicable laws or regulations

4. Term and Termination

This license is effective until terminated. Pojers may terminate this license at any time if Licensee breaches any term or condition of this Agreement. Upon termination, Licensee must cease all use of the licensed materials.

5. Disclaimer of Warranties

THE MATERIALS FROM POJERS SERVICES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. POJERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

IN NO EVENT SHALL POJERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

7. Entire Agreement

This Agreement and the Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior negotiations, representations, or agreements, whether written or oral.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Pojers operates, without regard to its conflict of laws principles.
